the end - curfew ordinance

(H) Any person who shall violate any of the provisions of this ordinance shall, upon conviction thereof, be sentenced to pay a fine of not more than Two Hundred ($200.00) Dollars and costs of prosecution. If any person shall be in default of payment of such fine and costs, such person may be sentenced to imprisonment for not more than five (5) days.

SECTION II

This ordinance shall become effective upon passage.

With one stroke, a curfew criminalizes a particular group of individuals for the sole reason that they might commit a crime.

As to the reasons given:
1) Is there a demonstrable problem with juvenile crime in the borough? Has there been a dramatic increase over the past 1, 2, 5, or 10 years?

2) IMO, the link between "promot(ing) the safety and well being of the Borough's youngest citizens," and telling them to get off the streets is tenuous.

3) It is not the business of the civil magistrate (i.e. government) to "foster and strengthen parental responsibility for children." It's the magistrate's responsibility to provide an atmosphere of liberty where parental duties are truly seen as responsibilities of the individual, not the state.
